If any conflict exists between these Terms and any policy on our site, the product-specific sections in this document, including Sections 2A, 4A, 15A, 16, and 16A, will control for purchases and use of Stealth Health Containers.

Welcome to Stealth Health Containers. The terms “we,” “us,” and “our” refer to Macro Containers LLC d/b/a Stealth Health Containers. We operate this website and store, including all related information, content, features, tools, products, and services in order to provide you with a curated shopping experience (the “Services”). The Services are powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these “Terms” or “Terms of Service”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, do not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ from how they appear on your screen due to your device and its settings.

We do not warrant that the appearance or quality of any products or services will meet your expectations or be the same as depicted or rendered online. All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities to any person, region, or jurisdiction.

SECTION 2A - PRODUCT USE AND SAFETY

By purchasing or using a Stealth Health Container, you agree to follow our Instructions & Use Guide and your appliance manufacturer’s directions.

  • Household microwave reheating only. Not for ovens, toaster ovens, air fryers, stovetops, broilers, grills, or commercial appliances.

  • Not dishwasher safe. Do not soak for extended periods.

  • Single use is recommended.

  • Heating outcomes vary because home appliances differ and because food varies by ingredients, moisture level, size and composition of the food being heated, and the overall density of the food being heated.

  • Remove the lid before reheating, or rest it loosely inverted on top. Use short microwave intervals and medium power. Stir between rounds. Never microwave an empty container.

  • Stop use if you observe softening, bubbling, or warping. Allow the container to cool before handling.

  • Verify food reaches a safe internal temperature of 165 °F. Use caution when opening after heating due to hot steam.

  • Compost only where accepted. Facilities may not exist in your area. Follow local rules.

Failure to follow this Section voids any warranty and may result in damage or injury.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Stealth Health Containers reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance and process your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the contact information provided at checkout.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices posted online may differ from prices offered elsewhere. We may run promotions that are governed by terms separate from these Terms. If there is a conflict between promotion terms and these Terms, the promotion terms will govern for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account and other information, including your email address and payment methods, so that we can complete your transactions and contact you as needed. You represent and warrant that you are authorized to use the payment method you provide and that you will pay all charges incurred, including taxes and shipping.

SECTION 4A - SUBSCRIPTIONS AND AUTO-RENEWAL

If you enroll in Subscribe & Save or any recurring purchase plan, you authorize recurring charges at the disclosed interval until you cancel.

  • You can pause, skip, or cancel at any time prior to the next renewal through your account or by contacting support.

  • Prices, discounts, and free-shipping eligibility may change. Any change will be communicated in advance and will apply to subsequent renewals.

  • Each renewal creates a new order subject to these Terms and our Refund Policy.

  • Where required by law, we will provide additional automatic renewal disclosures and reminders.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. Please inspect packages upon arrival and notify us promptly of any issues.

SECTION 6 - INTELLECTUAL PROPERTY

The Services and all trademarks, brands, text, images, graphics, product reviews, video, audio, and the design and arrangement thereof, are owned by Stealth Health Containers, our affiliates, or licensors and are protected by law.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store, or transmit any material on the Services without our prior written consent. Except as expressly provided, nothing in these Terms grants any license or right under any intellectual property of Stealth Health Containers, Shopify, or any third party. All rights not expressly granted are reserved.

Our names, logos, product and service names, designs, and slogans are trademarks of Macro Containers LLC d/b/a Stealth Health Containers or its affiliates or licensors. You must not use these without prior written permission. Shopify’s marks are trademarks of Shopify. Other names and marks are the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may be provided access to tools offered by third parties, which we neither monitor nor control. We provide access to such tools “as is” and “as available” without any warranties, representations, or conditions and without endorsement. Any use by you is entirely at your own risk and discretion and you should ensure that you approve the terms on which tools are provided by the relevant third parties. New features may be offered in the future and will be subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain materials and links to websites provided or operated by third parties. We are not responsible for examining or evaluating third-party content or accuracy. If you access third-party sites, you do so at your own risk. We are not liable for any harm or damages related to your access or use of third-party websites, products, services, resources, or content. Review third-party policies before any transaction.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Stealth Health Containers is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Stealth Health Containers. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Stealth Health Containers, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Stealth Health Containers.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, certain personal information is processed by Shopify in accordance with Shopify’s Privacy Policy, which can be viewed here: https://www.shopify.com/legal/privacy. By using the Services, you acknowledge that you have read these privacy policies.

SECTION 11 - FEEDBACK

If you submit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose. You represent and warrant that you own or have all necessary rights to the Feedback and that your Feedback complies with applicable law and these Terms. We may, but have no obligation to, monitor, edit, or remove Feedback at our discretion.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

SECTION 13 - PROHIBITED USES

You may use the Services for lawful purposes only. You may not use the Services to violate any law, infringe rights, harass or harm any person, transmit false or misleading information, transmit spam or malware, impersonate any person, or engage in conduct that restricts or inhibits others’ use or enjoyment of the Services. You also agree not to interfere with security features or to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services. We may suspend, disable, or terminate your account without notice if you violate these Terms.

SECTION 14 - TERMINATION

We may terminate this agreement or your access to the Services in our sole discretion at any time without notice. You remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Arbitration, and any other provisions that by their nature should survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available solely for general information. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is at your own risk.

EXCEPT AS EXPRESSLY STATED BY STEALTH HEALTH CONTAINERS IN SECTION 15A BELOW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE DISCLAIMER APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SECTION 15A - LIMITED WARRANTY

We warrant that Stealth Health Containers are free from manufacturing defects at the time of purchase.

  • Term: 30 days from delivery to the original purchaser.

  • Remedy: At our option, we will replace the product or refund the purchase price upon proof of purchase and proof of defect.

  • Exclusions: Misuse, failure to follow the Instructions & Use Guide, overheating, exposure to dry direct heat, commercial or abnormal use, modification, improper storage, accidents, or normal wear.

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL MACRO CONTAINERS LLC D/B/A STEALTH HEALTH CONTAINERS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS. IN THOSE PLACES, THE ABOVE LIMITS APPLY TO THE MAXIMUM EXTENT PERMITTED.

SECTION 16A - ASSUMPTION OF RISK AND INDEMNITY FOR PRODUCT USE

You understand that household appliances vary and that heating outcomes depend on the food’s ingredients, moisture level, size and composition of the food being heated, and the overall density of the food being heated. You agree to use the products as directed and assume all risks arising from any use that is outside the Instructions & Use Guide and your appliance manufacturer’s directions.

You agree to indemnify and hold harmless Macro Containers LLC d/b/a Stealth Health Containers from claims, damages, and expenses arising from misuse of the products, failure to follow the Instructions & Use Guide, or failure to follow your appliance manufacturer’s directions.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Stealth Health Containers, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of your breach of these Terms, violation of law, violation of third-party rights, or misuse of the Services.

SECTION 18 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by law and the unenforceable portion shall be deemed severed. The determination will not affect the validity and enforceability of any other provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior agreements or communications. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 20 - ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice.

SECTION 21 - GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of laws principles. You consent to venue and personal jurisdiction in the state and federal courts located in Dallas County, Texas.

SECTION 21A - ARBITRATION AND CLASS ACTION WAIVER

At our option, any dispute arising out of or relating to these Terms or the products may be resolved by binding arbitration on an individual basis. You and we waive any right to participate in a class or representative action. Judgment on the award may be entered in any court of competent jurisdiction. This section does not prevent either party from seeking injunctive relief in court for misuse of intellectual property or violation of confidentiality. Some jurisdictions restrict arbitration and class action waivers. Where restricted, this section applies to the maximum extent permitted. Consult your counsel to confirm any required disclosures for your state.

Headings are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time. You can review the most current version at any time on this page. We will notify you of material changes as required by law, and such changes will be effective on the date specified in the notice. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.
